TERMS & CONDITIONS

Please read the entire Terms & Conditions  before completing the Exhibition Application form. Submission of this form does not automatically result in acceptance for either the Polish Club Ashfield’s Exhibition schedule or listing on their online e-commerce platforms. It is an application for consideration by the Polish Club Ashfield Board of Directors, Polish Club Ashfield Management, and Curator Renata Brak.

ENTRANTS

• Entrants must be 18 years of age or above.

• Polish Club Ashfield fine art exhibition program are open to Australian resident artists whose submitted works draw directly from Polish culture.

• Entrants give Polish Club Ashfieldpermission to subscribe the entrant’s email address to Polish Club Ashfield.

mailing lists and agree that correspondence with Polish Club Ashfield will be via email.

ELIGIBLE WORK

• Drawing, watercolour, painting, graphics, printmaking, posters, illustrations, photography, graphic design, decorative art, printed digital art, sculptural pieces, mixed media including glass, and ceramics are accepted.

APPLICATION PROCESS

• Incomplete entry applications will not be considered.

• An artist may be required to provide additional information in connection with an application or a work

submitted. Failure to provide the additional information may result in rejection of the application or the work.

• Submission of an application form does not constitute any agreement from Polish Club Ashfield to list works in the visual arts exhibition program. The application form will be reviewed by the Selection Panel.

• The Selection Panel will be comprised of arts industry professional Renata Brak, The Polish Club Ashfield’s Board of Directors, and The Polish Club Ashfield’s Management team. This Selection Panel will review and assess all applications received and will select the works to be exhibited.

• The Selection Panel may accept some or all the submitted works for exhibition.

• Amongst other things, works will be selected based on compliance with the entry criteria, the quality of the work submitted and the work’s contribution to showcasing Polish cultural influence. Invitation to submit a work for final viewing by the Selection Panel does not guarantee that the work will be exhibited.

• The Selection Panel’s decision is final, and no correspondence will be exchanged regarding rejection of any work or applications.

• Applicants will be advised via email of the Selection Panel’s decision regarding their application no later than 2 months after submission.

• Successful applicants will be advised of contact details for The Polish Club Ashfield Curatorial team. The applicant agrees that all further correspondence with Polish Club Ashfield will be through the advised contact details.

CONSIGNMENT

Successful applicants will need to agree to the following terms. Applicants will need to understand the below to correctly complete this application form.

TERMS OF CONSIGNMENT

• All selected works must be made available for sale if the Application indicated they would be available for sale.

• All selected works must be made available for display at The Polish Club Ashfield during the successful nominated period of the exhibition: inclusive of bump in and bump out dates.

• Successful applicants will be advised of Exhibition dates no later than two months prior.

• The consignor agrees to notify The Polish Club Ashfield Curator immediately if any work which has been selected for the exhibition is no longer available for sale or if the consignor intends to withdraw the work from exhibition. All communication must be in writing.

• Applicants may elect to offer submitted works for sale.

• The applicant agrees that title to the artworks remains with the applicant for all works including those for sale, until an item for sale has been paid for in full by a third-party buyer, at which point title passes to the third-party buyer. Title never passes to The Polish Club Ashfield at any stage, who acts only as agent in the transaction.

ARTWORK DOCUMENTATION, PHOTOGRAPHY, AND INTELLECTUAL PROPERTY

• The consignor warrants that all work submitted is their original work and does not infringe the copyright,

moral rights or other rights of any third party. The consignor indemnifies the consignee against any actions brought about by third parties claiming infringement of any copyright, moral or any other rights.

• The consignor agrees to provide the consignee with all relevant documentation including provenance if applicable.

• The consignor agrees to provide the consignee with high resolution digital images of themselves and their artworks for the purpose of cataloguing and promotion on The Polish Club Ashfield website, social media platforms, EDM’s, and any promotional material whether physical or digital. Images must be 300dpi, 2000px (minimum on one side), RGB, .jpg format.

• The consignor agrees that the consignee may promote the artwork on any internal and external websites, social media channels, and any promotional material whether physical or digital.

• The consignor agrees that the consignee may include the artwork in any exhibitions.

• The consignor grants permission to The Polish Club Ashfield and/or their agents to publish any material submitted, as well as any material containing their artwork to promote The Polish Club Ashfield and any lead up events or future activities of The Polish Club Ashfield and its subsidiaries and licensees. The consignor agrees that this permission extends to promotion of future exhibitions operated by or under the direction of The Polish Club Ashfield.

• The consignor agrees that the provided information/text may be edited to comply with The Polish Club Ashfield’s brand guidelines.

FRAMING AND STRETCHING

• The consignor agrees to provide artworks in ready-to-exhibit state (must be stretched and/or framed).

• The consignor agrees to include D-Rings and any other hanging apparatus on their artworks.

• The consignor agrees to pay for any framing and stretching costs required.

FREIGHT AND INSURANCE

• The consignor agrees to pay all costs associated with transport and insurance of the artworks to the exhibition space.

• The consignor agrees to provide The Polish Club Ashfield Curator the tracking numbers once the artwork is in transit.

• The consignor agrees that selected works must be delivered to the exhibition space during the hours 10:00am – 5:00pm on the first Monday of scheduled exhibition (dates provided no less than two months prior) to The Polish Club Ashfield, 182 Liverpool Road, Ashfield, NSW, 2131, Australia. The artworks can be supplied by the artist, or by an art courier company.

• If the consignor is unable to deliver the artwork during these hours nominated, the consignor must organise an alternate delivery time and date with the Curator via email one month before, including the identity of the individual who will be collecting and/or delivering the works.

INSTALLATION

• The consignor agrees that all artworks must be clearly marked on the back of the artwork with the artist’s full name, the title of the artwork, year, medium and dimensions.

• The consignor agrees that all artworks to be hung must be ready to hang. This includes d-rings 20cm down the frame with a hanging wire.

• The consignor agrees that Photographs and other Works on Paper must be suitably mounted or otherwise prepared for display.

• The consignor agrees that Sculpture and 3D artworks must include instructions for display.

• The consignor agrees that the presentation of heavy works (10kg+) and works involving complex installations must be carried out by the consignor personally. In these instances, the consignor agrees to provide their own equipment and tools as required to effect installation.

• The consignor agrees that artworks requiring electricity for display will have a licensed electrician’s tag indicating a valid safety test.

• The consignor agrees that artworks requiring any trade license to install will be installed by a suitably licensed provider at the consignor’s cost and organised by the consignor after approval by The Polish Club Ashfield.

• The consignor agrees that the Curator will make the final decision where are works will be displayed.

SALE OF ARTWORKS AND COLLECTION OF SOLD ARTWORKS

• The consignee agrees to facilitate the sale of artworks identified for sale by the consignor in the form.

• The consignor agrees for the consignee to be their agent in such sales.

• The consignee agrees to facilitate the collection of sold artworks by the purchasing client.

• The consignee agrees to allow client collection of the purchased artwork only once the exhibition has closed. Clients will be able to collect purchased artwork from the exhibition space during the hours 10.00am – 5.00pm once the exhibition has commenced.

• The consignee agrees to arrange for packaging, shipping, and insurance of sold artworks at the client’s request and at the client’s cost.

PRICES

• The consignee agrees to sell the works identified for sale in the application form for the retail price stipulated unless consent is obtained to vary the price in writing from The Polish Club Ashfield. Any request to vary the price must be made in writing and will take 14-28 days to be considered. If agreed by The Polish Club Ashfield the price will take effect following agreement and notification to the consignor. No price changes will be accepted once artworks are on display.

• The consignor agrees that the stipulated retail price is the final price inclusive of the 25% commission payable to The Polish Club Ashfield & 5% to Curator Renata Brak, & inclusive of GST which will be payable.

• The consignee agrees to add a shipping fee to the price as required by the purchaser, including GST applicable to the shipping cost, and agrees to arrange any shipping required by the purchaser for sold works.

COMMISSIONS AND PAYMENT

• The consignee agrees to deduct a 30% commission (15% to The Polish Club Ashfield and 15% to the Curator Renata Brak) from the ex-GST sale price (not including the shipping fee, if any) of each artwork prior to any payment being made to the consignor.

• The consignee agrees to make payment for sold artworks within 14 days of funds clearing the payment processor (i.e. appear in the consignee bank account) and confirmed goods receipt by the purchaser.

• The consignor agrees to be responsible for providing the consignee with documentation that will enable claims to the ATO in respect of any Australian Goods and Services Tax remission receivable upon the sale of the work in the form of a Remittance Advice.

RETURN OF UNSOLD ARTWORKS

• The consignor agrees to collect all unsold works from the exhibition space during the hours 10.00am – 12.00pm on the Monday following the exhibition commencement. Dates will be supplied to the consignor no less than two months prior.

• The consignor agrees that Sculpture and 3D artworks must include instructions for deinstallation.

• The consignor agrees that the deinstallation of heavy works (10kg+) and works involving complex deinstallations must be carried out by the consignor personally. In these instances, the consignor agrees to provide their own equipment and tools as required to effect deinstallation.

• The consignor agrees that artworks requiring any trade license to deinstall will be deinstalled by a suitably licensed provider at the consignor’s cost & organised by the consignor.

• The consignor agrees that if they are unable to be present at deinstallation of the exhibition the consignor will arrange for an artwork courier to pack and remove the work(s) during specified hours and will advise the Curator of The Polish Club Ashfield and the identity of the art courier via email before exhibition commencement.

• The consignor agrees to pay all costs associated with the transport and insurance for the return of all unsold works to the address of origin. The consignor agrees that The Polish Club Ashfield will not make any arrangements for the return transport of works.

• The consignor agrees that works not collected will be deemed to be the property of The Polish Club Ashfield from one month after exhibition commencement and may be sold or otherwise disposed of by the Curator acting in the best interests of The Polish Club Ashfield. The Curator will continue to be contactable via email until this date to arrange an alternative collection.

• The consignor agrees that any costs incurred by The Polish Club Ashfield in association with works not collected will be payable in cash by the consignor as a condition of late collection.

RISK

• The consignor agrees that the artworks will be at the consignor’s risk during shipping to and from the exhibition and will be covered by insurance to be arranged by the consignor.

• The consignor releases The Polish Club Ashfield and its agents, contractors and sub-contractors from and agrees that The Polish Club Ashfield is not liable for any damage of any kind caused to the artworks during shipping to and from the exhibition.

• The consignor releases The Polish Club Ashfield and its agents, contractors and sub-contractors from and agrees that The Polish Club Ashfield is not liable for any damage of any kind caused to the consignee and any third parties during shipping to and from the exhibition.

• The consignee agrees that the artworks will be at the consignee’s risk during exhibition and will be covered by insurance to be arranged by the consignee, unless the risk event results directly from unsafe installation by the consignor or their agent(s), for which the consignor agrees to be at risk and for which the consignor agrees to be covered by insurance to be arranged by the consignor.

• The consignee agrees that the sold artworks will be at the consignee’s risk when they are shipped to a purchaser at the purchaser’s request, for which the consignee agrees to be covered by insurance to be arrange by the consignee.

FORCE MAJEURE

• Where, for any reason beyond the reasonable control of The Polish Club Ashfield including, for example, earthquake; flood; fire; act of God; terrorism; pandemic; government directions, orders or regulations; labour strikes or other emergency event, The Polish Club Ashfield is prevented or materially hindered from holding an exhibition of works at the exhibition space then it may vary, postpone or cancel the event by notice in writing to that effect to the artists and by a notice on its website. All costs already incurred by either party prior to such an event will be their costs and no claim may be made against the other party against such costs.
