Terms and Conditions

By accessing or using Our Websites or Services, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of the Websites.

We may update these Terms and Conditions from time to time. Any changes apply only to future use of the Websites and will not affect orders already placed.

 

Definitions

In these Terms:

• Services means the informational and transactional services offered on the Websites.
• Websites means renataartdesign.com and renataartdesign.com.au.
• We / Us / Our means RENATA ART DESIGN and Brak Industries Pty Ltd, including our officers, employees, contractors, agents, successors and assigns.
• You / Your means any user of the Websites or purchaser of artworks or Services.

 

Accuracy of Content

We take reasonable care to ensure information on the Websites is accurate, current and complete. However, to the extent permitted by law, we do not warrant the accuracy, reliability or completeness of the content.

Information is provided for general informational purposes and does not constitute professional advice. Views expressed by third parties are their own.

Nothing in this clause limits any rights you have under the Australian Consumer Law (ACL).

 

Use of the Websites

You agree to use the Websites in accordance with all applicable laws and not to engage in behaviour that is:

• unlawful, defamatory, discriminatory, harassing, abusive, fraudulent or obscene
• intended to interfere with the Websites or the Services
• harmful to others, including attempts to hack or disrupt the Websites
• in breach of intellectual property rights

We may moderate or remove comments or content at our discretion.

We may refuse or suspend access to the Websites where you breach these Terms. This does not affect any orders already accepted by us.

 

Availability of Items

All artworks and items listed for sale are subject to availability.

If an item in your order becomes unavailable before fulfilment, we will contact you and offer an exchange or refund.

Artworks displayed in exhibitions must remain on display until the published exhibition closing date. By purchasing an exhibition artwork, you agree that collection occurs only after the exhibition ends.

 

Product Descriptions, Sizing and Unique Characteristics

Images, colours, dimensions and descriptions are provided as a general guide only. Colours may vary depending on device settings.

Artworks are hand-made, unique, one-of-a-kind objects and may contain minor imperfections inherent to handcrafted items. These characteristics do not necessarily indicate a defect.

Artworks are intended for indoor, stationary display only and are not designed for functional use.

If you require additional information about an artwork, please contact us before purchasing.

Nothing in this clause limits your rights under the ACL.

 

Orders

You must provide accurate personal information when placing an order. We are not responsible for delays or non-delivery caused by incorrect details supplied by you.

By providing credit card or payment details, you confirm that you are authorised to use that payment method and that sufficient funds are available.

If you wish to amend or cancel an order, please contact us as soon as possible. We cannot guarantee amendments or cancellations once an order has been processed.

We may cancel an order if:

• the item is unavailable,
• there is a pricing or description error, or
• we reasonably suspect fraud.

If we cancel an order, we will notify you and provide a full refund.

 

Pricing and Taxes

All prices are in Australian dollars (AUD).

RENATA ART DESIGN is not registered for GST, and no GST is charged.

Prices may change from time to time, but you will be charged the price displayed at the time your order is submitted.

 

Collection / Pick-Up of Artworks

We do not deliver artworks. We accept orders from within Australia only.

If you purchase an artwork displayed in an exhibition, you agree to collect it from the exhibition location between 10:00 am and 5:00 pm on the Wednesday following the exhibition’s close.

Risk of loss or damage to the artwork passes to you upon collection.

If you fail to collect the item within a reasonable time, we may contact you to arrange an alternative collection time. Storage or handling fees may apply.

 

Returns, Refunds and ACL Rights

Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for reasonably foreseeable loss. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure is not major.

Nothing in these Terms excludes, restricts or modifies any consumer rights under the ACL.

We do not offer refunds or exchanges for change-of-mind purchases.

If your artwork is faulty or not as described, please contact us within 7 days with supporting photos. This request period does not limit your ACL rights.

If an ACL remedy applies, we will work with you to arrange a repair, replacement, refund, or other appropriate remedy.

Where the artwork must be returned, we will provide a return address.
For ACL returns:

• You will not be required to return the item in its original packaging if this is not reasonably possible.
• We will cover return shipping costs where required by the ACL.
• Insurance is not mandatory for ACL returns.

For non-ACL returns agreed at our discretion, you are responsible for return costs and ensuring the artwork is appropriately packaged.

Refunds are issued to the original payment method once the item is received (where applicable) and inspected.

 

Information Collection and Privacy

Your personal information is collected solely for the purposes of fulfilling your order, managing returns/exchanges, operating the Websites, and (if you opt in) sending newsletters or updates.

Our payment processor, WooCommerce Payments, handles credit card details on our behalf. We do not store your full payment card details.

Use of your personal information is governed by our Privacy Policy, which forms part of these Terms.

 

Confidentiality and Security

While we take reasonable precautions to protect your information, we cannot guarantee absolute security due to global internet risks.

Nothing in this clause limits our obligations under applicable privacy or consumer laws.

 

Passwords and Logins

You are responsible for maintaining the confidentiality of any login details associated with your account and for activities carried out under those details.

Notify us immediately if you become aware of unauthorised access.

 

Indemnity

You agree to indemnify us from loss or liability arising from your:

• breach of these Terms,
• unlawful use of the Websites, or
• infringement of our intellectual property rights.

This indemnity does not apply to matters caused by our negligence, breach of law, or failure to comply with the ACL.

 

Intellectual Property

We own the copyright and intellectual property in the Websites and all associated content, including images, artwork photographs, graphics, layout, code and text, unless otherwise stated.

You may browse the Websites and share links for personal, non-commercial purposes. You must not reproduce, sell or exploit any content for commercial use without our written permission.

 

Trademarks

Trademarks and logos appearing on the Websites are owned by RENATA ART DESIGN or Brak Industries Pty Ltd. You must not use them without our express written consent.

 

External Links

The Websites may contain links to third-party sites. We do not endorse these sites and are not responsible for their content.

You may link to our home page or articles provided the link does not imply endorsement or affiliation. We may revoke linking permission at any time.

 

Malware and Cybersecurity

We take reasonable steps to ensure the Websites are free from malware and other threats, but we do not warrant that use of the Websites will be uninterrupted or error-free.

 

Limitation of Liability

To the extent permitted by law and except as required by the ACL:

• we exclude all implied warranties,
• we are not liable for indirect, incidental or consequential loss arising from use of the Websites or Services.

Nothing in these Terms limits our liability for consumer guarantees under the ACL, negligence resulting in personal injury, or any other liability that cannot be excluded by law.

 

Governing Law

These Terms are governed by the laws of New South Wales, Australia. Disputes may be brought before the courts of NSW or any jurisdiction permitted under the ACL.

If any clause is invalid in any jurisdiction, the remaining clauses continue to operate.
